Clarification Text On Personal Data Processing

As the Better Justice Association (“Association”), we give importance to protection of your personal data. We would like to inform you with this clarification text (“Clarification Text”) about how the personal data of the visitors are processed in accordance with the Law No. 6698 on Personal Data Protection and the secondary regulations (“PDP legislation”) when you visit our official website https://www.dahaiyiyargi.org/.

 

For which purposes and how do we obtain and process your personal data?

As the Association, in our capacity as a data controller, we collect your personal data through automatic or non-automatic means, in writing, verbally or electronically.

 

Once you visit the address https://www.dahaiyiyargi.org/; your data and the traffic data in particular are processed by our Association electronically and physically in writing, through automatic and non-automatic means, in accordance with the PDP legislation and for the purposes of fulfilling our obligations originating from the Law On Regulation of Publications on The Internet And Combating Crimes Committed By Means of Such Publications numbered 5651 and related secondary regulations.

 

In addition; we use certain cookies in a manner limited and proportionate to our legitimate interests for the purposes of systematically recording and monitor your visits and to use them as a part of our business development process. In this way; it is aimed to get statistical information about how many users visit the website, for which purpose and how many times a person visit the website and how long the visitors stay on our website. We also process the personal data provided to us in order to record, answer and monitor all requests submitted through our website as well as to conduct the Association’s activities (i.e. collection donations, collection subscription fees, writing receipts), within the framework of our legitimate interests and in a restrained manner limited to the purpose of fulfilling our legal obligations.

 

Personal data of our Association’s members and/or the persons who file membership applications may be processed in order to inform them about the Association’s activities and planned events and commercial e-mails are sent to them subject to their consent.

 

Finally; we process your personal data which are submitted in the Association membership form (including the sensitive personal data) for the purposes of recording and evaluating the membership applications, in a limited and restrained manner and within the scope of our legitimate interests. Beside this; we process your personal data about your membership with other associations, which are deemed sensitive personal data, subject to your explicit consent and in accordance with the PDP legislation. Audio and visual records of the events organized by the Associations are kept by the Association and within this scope; personal data of the members and relevant persons are processed within the framework of our legitimate interests, in accordance with the laws and in a restrained manner.

 

To whom and for which purpose is your personal data disclosed?

We disclose your personal data listed in this Clarification Text to third party service providers (advertising agencies, IT specialists, database providers, back-up and retrieval experts in connection with and limited to the purposes of conducting the Association’s activities in addition to the purposes specified in this text and also with other members for the purpose of running the membership processes and  publishing these parties on our website in accordance with provisions of the Association’s Charter and we disclose the names, surnames and details about the organization where the relevant member work to public in accordance with the PDP legislation.

 

The third parties to whom we disclose your personal data shall be liable to process your personal data in connection with and in a manner limited to the intended purpose and to protect this data within the scope of our contractual relationship unless otherwise provided in the PDP legislation and these parties are controlled by our Association.

 

Finally, we disclose your personal data to government agencies, official bodies and judicial authorities with the purpose of fulfilling our legal responsibilities and obligations, in accordance with the PDP legislation.

 

Is your Personal Data transferred abroad?

Your personal data is not transferred abroad.

 

Security, storage and destruction of your personal data

Your personal data shall be stored during the period required for the processing purposes specified in this Clarification Text and in any case, during the legal limitation periods set forth in the legal regulations. Upon expiry of the referred periods, our Association shall delete, destroy or anonymize your personal data in accordance with the Personal Data Storage and Destruction Policy.

 

Your Rights originating from the PDP Legislation

Within the scope of Article 11 of the Law No. 6698 on Protection of Personal Data; you have the right to apply to our Association and (i) to learn whether your personal data is processed or not; (ii) to request information if your personal data is processed, to learn the purpose of data processing and whether this data is used for intended purposes; (iii) to know the third parties to whom your personal data is transferred at home or abroad, to request the rectification of the incomplete or inaccurate data, if any; (iv) to request the erasure or destruction of his personal data under the conditions laid down in Article 7; (v) to request notification of the operations carried out in compliance with subparagraphs (d) and (e) to third parties to whom his personal data has been transferred; (vi) to object to the processing, exclusively by automatic means, of his personal data, which leads to an unfavourable consequence for the data subject and  (vii) to request compensation for the damage arising from the unlawful processing of your personal data. This Clarification Text shall be revised and published on our website in accordance with the legislation and secondary regulations, as amended from time to time.
